We have hired an attorney! Time to put up a fight, baby!!! It’s now been 2 1/2 months since we got laid off and those ass hats STILL haven’t given us our last paycheck. Bunch of turd buckets… What kind of people steal 80 hours of work from their colleagues?? Over Christmas? Blech.
I just don’t understand why people can’t act like normal civil adults and do what’s *right*. I get that companies lose money and go out of business, BUT it doesn’t happen ASAP, and especially when you’re backed by million dollar investment companies. Those jackals have been quiet for 1 month now without even the slightest peep about paying us. In fact, you know what the last thing they said to me was, actually?? “If you don’t return the stolen merchandise, we will go after you” — HAHAHAHAHA!!! Give me a break. Like I’d ever do something stupid like that… and when they found the culprit? (which I knew who it was all along) – nothing. Not even a “sorry.” Just plain ol’ silence as if I never even existed… guess that entire office moved itself the week before!!
So, yes — we have taken up legal and a nice little letter is currently in the works to start the process. All half-dozen or so of us are teaming up and apparently there’s a whole mess of fines that add up every day that goes by without pay. Not that I really care about that to be honest with you (all I want is my WELL-deserved paycheck), but I guess it helps us when starting out with a high dollar amount. That way if they knock us down and we have to fight back and forth in negotiations, we’ll hopefully at *least* get what’s rightfully ours. Minus all the legal fees and what not too, sigh… but we’ll see what happens. Either they get scared and pay us right away and we avoid all court action, or we have to fight the good fight till the bitter end! Which we will all gladly do :)
It’s the principle of the matter now. Time to stand up for our honor! I’ve accepted the fact I may never see that $3,000 again, but I refuse to lay down and let those corporate mongels tread all over us. It’s high-time to rumble, baby.

Part of the reason I started following was to find out whether you’d ever get your check… and I thought it would be awkward to drop in on another post like:
“Stranger Commenter”: “So did you ever get paid? Did you ever get those wedding pics too?”
For what it is worth, I agree that it is the principle. I chase down everything that I am owed these days because it is totally unfair how easily taken advantage of we are in the “E” quadrant (ref: Kiyosaki). I’m now in the S/B quadrants, but I remember the “oh we just decided to lay you offs” and “final checks” and how they treat you like an underling or hardened criminal after they’ve screwed you over.
I can’t believe that a company would ever refuse to pay their (former) employees what is owed to them. But maybe I’m a little naive… I guess corporations really can be corrupt at times!
I hope you guys get what is due to you soon. Not that you are hurting without that last paycheck, but an extra $3k never hurt anyone!

Are you able to sue them for your paychecks as well as the cost incurred by suing them in order to get the paycheck?
I agree with Cassie, they should have to pay for the cost of the legal action along with you earned paycheck. It is ridiculous that they have not paid you and these others for the work done. Of course they should have had the checks cut and ready to mail out when they found the culprit.
It’s sad how *not* surprising it is to me that a corporation would do this. I’m happy you’re teaming up to take what is yours and I’m keeping my fingers crossed for all of you. Good luck!
I STRONGLY recommend now that you have taken this step you not post any more here about your employer or the case. They could make this an issue. Mum’s the word, and gives you a stronger negotiating position.
I can’t believe they have taken this long. I can easily see a company delay until that last day before there are potential legal penalties. But your situation is nuts. Best of luck getting the entire paycheck + your legal fees recovered!
Just caught up on what happened. That seriously sucks. It’s a bunch of bull-crap. You keep fighting J. Money! That’s some serious cash, and extremely unethical what they did…
Here’s an idea. Find out where your boss lives and drop a bag of burning poo at his door haha.
If you were making 70K/yr, how was your paycheck 3K for 80 hrs of work? shouldn’t it be more like 2K?

Good for you J. Money! I believe that what is yours should be given to you. I’m glad that my boss always makes sure payroll is first over all bills.
I also agree with Diane that you should not talk anymore about this situation on your blog as they can get all of your posts, rants, etc. and turn them against you.

Stiffing a guy for his paycheck is one of the uncoolest things an employer could do. I hope you get everything that’s due you plus whatever penalties and interest are owed plus 500% of whatever the penalties and interest are.
This is so sad. It seems once you leave a job they no longer care about you. I have to agree with the others and say even though you’re “anonymous” you should just keep things to yourself for now. Or ask your attorney if you can talk about it but its best to keep things low, employers especially bad ones have a way of finding things out and making things really ugly.
I’m on your side dude though, and I wish you the best. You are owed your paycheck and I hope you get it. Its kind of sad its come to this you know? Why couldn’t your company work things out diplomatically.

I love reading your posts but haven’t commented before. This one especially resonated with me since I’ve been following the developments in Madison, WI. It’s dark times for workers since corporations and government officials like Gov. Walker don’t give a whit about union rights or the rights of individuals to protect themselves from unethical treatment by employers. You’re right to take issue with these jackals for not paying you for hours worked. Legal battles can be exhausting to the wallet and the soul, but don’t give up!

@Cassie – According to our attorney, there are a LOT of things we can go after… penalties, legal fees, etc etc. In a perfect world it would be cool to get double my money owed (which I hear could be a possibility depending on what path it goes down), but I’d be just as happy getting what’s rightfully owed to me. $3k can go a lot farther now that it could 3 months ago, I’m getting frugal’er, baby!

I was soooooooo respectible and understanding and just 100% NICE and on my boss’s side the entire time people were giving him $hit. I stood up for him throughout it all, and then he goes out and attacks my credibility like that. F’ing not right man… and the funny part is he goes around calling himself a “Christian man”… I’m not a saint myself, but he’s gotta learn how to mix that part of his life w/ his company cuz he’s just off his chain man.
@Anon – No worries at all, that’s a valid question :) I just divided by 24 (the amount of paychecks a year roughly) and rounded up. I think the actual amount is $2,800-something, but didn’t bother going to look up.
@IPA – Yeah, you’d think :) It might be bad business practice, but in LIFE people should come first. Sad sad world we live in sometimes…

Glad you went the lawyer route, J. Sometimes a “friendly” little letter from a law office is all it takes. I hope that’s the case and that will be the end and you can get what’s rightfully yours. :)
